Swimming pools(including spa pools and portable pools) are required to be registered and have a fence compliant with the pool safety standard.

A quick indication as to whether or not a swimming pool needs to registered and fenced is if:

• the swimming pool is capable of holding a depth of water of 300mm or more; or
• the swimming pool has a volume of greater than 2000 litres; or
• the swimming pool has a filtration system. 

However, to accurately determine the requirements for registration and fencing it is necessary to have regard to:

• the Building Act 1975
• the Mandatory Part (MP) 3.4 of the Queensland Development Code (Swimming Pool Barriers)

A fence is required even if the pool is only installed temporarily (e.g. inflatable pool from a discount store).
